Privacyverklaring

UW PRIVACY

Voor een goede behandeling is het noodzakelijk dat uw behandelaar een dossier aanlegt. Dit is een wettelijke plicht opgelegd door de Wet op de geneeskundige behandelingsovereenkomst (WGBO). Uw dossier bevat uw persoonsgegevens, aantekeningen over uw gezondheidstoestand en gegevens over de uitgevoerde onderzoeken en behandelingen.

Ook worden in het dossier gegevens opgenomen die voor uw behandeling noodzakelijk of van belang (kunnen) zijn, bijvoorbeeld uw woon- en werksituatie, hobbys, gezinssituatie/burgerlijke staat. Of gegevens die, na uw uitdrukkelijke toestemming, zijn opgevraagd bij uw huisarts of een andere zorgverlener.

Uw behandelaar doet zijn/haar best om uw privacy conform de Algemene Verordening Gegevensbescherming (AVG) te waarborgen:

• door zorgvuldig om te gaan met uw persoonlijke en medische gegevens
• en door te zorgen dat onbevoegden geen toegang tot uw gegevens hebben.

Hierover worden afspraken gemaakt met bijvoorbeeld collegas en worden maatregelen genomen om de gegevens veilig te bewaren.

Uw behandelaar is gehouden aan het Privacy Reglement van de Nederlandse Vereniging voor Acupunctuur (NVA). U kunt dit reglement inzien op de NVA-websitewww.acupunctuur.nl

Alleen uw behandelaar, eventueel aanwezige stagiair (na uw toestemming) en waarnemer bij afwezigheid van uw behandelaar (na uw toestemming) hebben toegang tot de gegevens in uw dossier. Zij hebben allen geheimhoudingsplicht.

Een klein gedeelte uit uw dossier (naam, adres, woonplaats, geboortedatum) wordt verstrekt aan een (soms twee) bevoegd(e)(e) perso(o)n(en) voor de financile administratie (boekhouding, verstrekken van een factuur/nota).

Mijn dienstverlening is onderhevig aan de wetgeving op het gebied van gezondheidszorg in Nederland en het Nederlands recht in het algemeen, bijv. WGBO, Wkkgz, AVG.

Doel van de gegevensvastlegging

• (para-)medische behandeling in de vorm van Klassieke Chinese geneeskunde
• verwijzing
• administratie, maken van afspraken
• innen van consultkosten
• facturering t.b.v. clint en, indien van toepassing, zorgverzekeraar
• voldoen aan een wettelijke verplichting (bijv. belastingaangifte)

In uw dossier wordt genoteerd

• naam, adres, woonplaats
• telefoonnummers
• e-mailadres
• geboortedatum

Bijzondere persoonsgegevens

• Burger Service Nummer (BSN)
• (para-) medische gegevens
• relevante sociaal maatschappelijke gegevens (bijv. relatie, kinderen, woon- en werksituatie, hobbys/ sport)
• contactgegevens van de huisarts en/of andere behandelaars.

Bij minderjarigen < 16 jaar komt erbij

• naam, adresgegevens, telefoonnummer en mailadres van beide ouders
• schriftelijke toestemming van beide ouders

Bewaartermijn dossier

• 15 jaar na de laatste wijziging/ toevoeging (WGBO)

Uw gegevens kunnen ook gebruikt worden voor de volgende doelen:

• om (na uw toestemming) andere zorgverleners te informeren, bijvoorbeeld als de behandeling is afgerond of bij verwijzing naar een andere behandelaar;
• voor het gebruik door een waarnemer tijdens afwezigheid van uw therapeut;
• voor geanonimiseerd gebruik tijdens intercollegiaal overleg, onderricht aan stagiaires of overige lesdoelen;
• geanonimiseerd (na uw toestemming) voor wetenschappelijk onderzoek

Indien uw behandelaar vanwege een andere reden gebruik wil maken van uw gegevens, dan wordt vooraf om uw toestemming gevraagd.

De Zorgnota

Op de zorgnota staan de gegevens, die door de zorgverzekeraar worden gevraagd.

• uw naam, adres, woonplaats
• uw geboortedatum
• mogelijk BSN
• de datum van de behandeling en het factuurnummer
• korte omschrijving van de behandeling
• prestatiecode, bijvoorbeeld 24104 acupunctuur
• de kosten van het consult
• of u de nota reeds betaald hebt of nog zult betalen.

Uw rechten:

• Bij de intake vraag ik uw toestemming voor het vastleggen en verwerken van uw gegevens;
• Ik noteer uw toestemming in uw dossier;
• Ik noteer niet meer gegevens dan voor het omschreven doel nodig is;
• U heeft het recht op intrekking van verleende toestemming*;
• U heeft het recht op inzage, correctie, verwijdering en het meenemen van eigen gegevens (dataportabiliteit)*;
• U heeft het recht om een klacht in te dienen over hoe met uw persoonsgegevens omgegaan wordt bij mij* en bij de Autoriteit Persoonsgegevenswww.autoriteitpersoonsgegevens.nl;
• Ik wijs u op mijn privacy beleid en waar u deze kunt vinden.

Personen die toegang hebben tot de dossiergegevens, buiten de zorgverlener:

• Waarnemers
• Stagiaires
• Collega bezoekers
• Deze personen zijn bekend met de regels m.b.t. privacybescherming en hebben een geheimhoudingsplicht.
• Deze personen hebben alleen toegang tot uw gegevens, als u hiervoor toestemming hebt gegeven in de behandelovereenkomst.

Ik tref maatregelen om uw gegevens te beschermen

• Technisch (beveiliging van dossiers, computer etc.)
• Organisatorisch (afspraken en overeenkomsten)
• Ik gebruik beveiligde websites (SSL)
• Ik neem niet deel aan Facebook en Whatsapp
• De op mijn websites gebruikte cookies dienen uitsluitend voor technische doeleinden welke samenhangen met het gebruiksgemak van de sites.

Meldplicht datalekken

• Ik beschik over een protocol datalekken.

Privacy

For proper treatment it is necessary to make a file with your personal data.. This is a legal obligation imposed by the Medical Treatment Contracts Act (WGBO).

Your file contains your personal data, notes about your health status and data about the examinations and treatments performed.

The file also contains information that may be necessary or important for your treatment, for example your living and working situation, hobbies, family situation / marital status. Or details that, after your explicit consent, have been requested from your doctor or another healthcare provider.

Your practitioner does his / her best to guarantee your privacy in accordance with the General Data Protection Regulation (AVG):

Take great care of your personal and medical details
Make sure unauthorized persons cannot access these data

Agreements are made with colleagues, for example, and measures are taken to keep the data secure.

Your practitioner is bound by the Privacy Regulations of the Dutch Association for Acupuncture (NVA). You can view these regulations on the NVA website www.acupunctuur.nl

Only your practitioner, any trainee present (after your permission) and observer in the absence of your practitioner (after your permission) have access to the data in your file. They all have a duty of confidentiality.

A small part of your file (name, address, place of residence, date of birth) is provided to (sometimes two) authorized person (s) for the financial administration (accounting, issuing an invoice). note).

My services are subject to health care legislation in the Netherlands and Dutch law in general, eg WGBO, Wkkgz, AVG.
